DEFINITIONS

1. "WE","US" refers to the owners of the site.
2. "YOU" refers to the end-user using the site.
3. "PARTNERS" refers to the services we use for functionality such as, but not limited to, making revenue, gather information, handle paying

1. Account Registration

You agree not to use our Services for any illegal or unauthorized purpose. You must not, in the use of the Services, violate any laws in your jurisdiction.

2. Services

2.1 Provision of Services

Floppa Hosting agrees to provide you with the Services described on our website, subject to these Terms and any applicable service level agreements.

2.2 Service Availability

We strive to ensure the availability of our Services but do not guarantee uninterrupted or error-free operation. We may perform maintenance or updates that could affect service availability. In case you find an issue, report it to us immediately.

You are responsible for all content that you upload, post, or otherwise transmit through our Services. You agree not to upload, post, or transmit any content that:

• Is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable;

We will bill you in advance for the use of our Services. You must provide accurate billing information and promptly update us with any changes.

If you fail to pay any fees on time, we may suspend or terminate your access to the Services.

4.4 Refunds

If you wish to refund your chosen plan, we reserve the right not to if you don't fit by our criteria including but not limited to:

• You have been subscribed for more than 15 days;
• You have broken our ToS;

5. Termination

5.1 Termination by You

You may terminate your account at any time by contacting us or using the termination page on the admin panel. Termination will be effective immediately upon our receipt of your request.

5.2 Termination by Us

We reserve the right to terminate or suspend your account and access to the Services at our discretion, without notice, if you violate these Terms or any applicable law.

5.3 Effect of Termination

Upon termination, you will lose access to the Services and any data or content stored on our servers. We are not liable for any loss of data or content as a result of termination.

6. Limitation of Liability

To the fullest extent permitted by law, Floppa Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Services;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from our Services;
• Any bugs, exploits, viruses, trojans, or alikes that may be transmitted to or through our Services by any third party;
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services.

7. Indemnification

You agree to indemnify, defend, and hold harmless Floppa Hosting, its affiliates, and their respective employees from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.

8. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes to the Terms by posting the revised Terms on our website. We will also announce the date of the latest ToS change on discord and change it in the beginning of this document. Your continued use of the Services after such modifications constitutes your acceptance of the new Terms.

9. Governing Law

These Terms and any disputes arising out of or relating to these Terms or the Services will be governed by and construed in accordance with the laws of the jurisdiction in which Floppa Hosting is headquartered, without regard to its conflict of law principles.
